1. Agreement
These Terms of Use (the “Terms”) form the agreement between you (“you”, the customer) and Sendr365 (“Sendr365”, “we”, “our”) governing your access to and use of the Sendr365 platform at sendr365.com and the related APIs, SMTP relay, dashboard, and ancillary services (collectively the “Service”).
By creating an account, accessing the Service, or sending any email through Sendr365, you accept these Terms. If you do not agree, do not use the Service.
2. Account & eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter contracts.
- Sendr365 is a B2B service. Account registration requires a valid business email. Free / consumer email providers (Gmail, Yahoo, Outlook, etc.) are not accepted.
- You are responsible for keeping your credentials secure. Notify [email protected] immediately if you suspect unauthorised access.
- One account per organisation. Sharing credentials across companies is prohibited.
3. Acceptable use & anti-spam
You may only send email through Sendr365 to recipients who have given you clear, documented permission to receive it. Specifically you must not:
- Send unsolicited commercial email (spam) of any kind.
- Send phishing, fraudulent, deceptive, malware-bearing, or impersonating content.
- Use scraped, purchased, or rented mailing lists.
- Use the Service to harass, defame, threaten, or violate the rights of any party.
- Send content prohibited by law in the recipient's jurisdiction (CAN-SPAM, GDPR, CASL, India's DPDPA, the UAE TDRA Spam Regulation, etc.).
We monitor send health automatically. Accounts exhibiting bounce rates above 5%, complaint (FBL) rates above 0.3%, or sustained failure rates may be throttled, paused, or suspended without prior notice.
4. Domain ownership & sender identity
You may only send mail from a domain you own and have verified through our DNS verification flow (SPF, DKIM, DMARC). Attempting to send from a domain you do not control will be blocked at the relay layer.
5. Plans, credits, and billing
- Sendr365 offers monthly subscription plans (Pro / Scale family for transactional and marketing email) plus one-off credit packs. The current price catalogue is shown at /pricing and inside the dashboard and is the authoritative source.
- Subscription fees and credit packs are paid in cryptocurrency through NOWPayments. The crypto-to-USD conversion rate is locked at checkout time.
- Plan allowances reset at each billing cycle and do not roll over. Purchased credit-pack balances do not expire.
- Refund policy: paid credits and subscription fees are non-refundable after 7 days from purchase, except where required by law or in the case of a documented service failure attributable to us.
- We may change pricing on prospective billing cycles with at least 30 days' notice via email or in-product banner. Existing paid periods are honoured at the rate paid.
6. Service availability
We target 99.9% monthly uptime for the API, SMTP relay, and dashboard. We do not currently offer formal SLAs below the Enterprise tier. Brief planned maintenance windows may occur; we announce them in advance whenever practical.
7. Suspension & termination
We may suspend or terminate your account, with or without prior notice, for:
- Violation of Section 3 (Acceptable use).
- Non-payment, chargebacks, or fraudulent payment activity.
- Action that puts the Service's deliverability or infrastructure at risk.
- Compliance with a legal order or regulatory obligation.
You may close your account at any time from Settings → Billing or by emailing [email protected]. On termination, all account data is permanently purged within 30 days, except records we must retain for legal, accounting, or anti-fraud purposes.
8. Intellectual property
You retain all rights to the email content, mailing lists, templates, and any other data you upload to or create on Sendr365. We claim no ownership over your data. The Service itself, including the dashboard UI, brand assets, and API, remains the property of Sendr365.
9. Liability limitations
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available” without warranty of any kind, express or implied.
- Sendr365's total aggregate liability under these Terms is capped at the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data, even if advised of the possibility of such damages.
10. Indemnification
You agree to defend and indemnify Sendr365 against any third-party claims, damages, or expenses arising from your content, your use of the Service in violation of these Terms, or your violation of applicable law.
11. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated by email and through an in-product banner at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
12. Governing law & disputes
These Terms are governed by the laws of the jurisdiction where Sendr365 is incorporated. Any dispute arising under these Terms will be resolved through good-faith negotiation first, then binding arbitration if negotiation fails.
